On November 5, 2008, NCLR as lead counsel, along with the ACLU and Lambda Legal, filed a writ petition with the California Supreme Court seeking to invalidate Proposition 8. The state’s high court agreed to exercise its original jurisdiction and hear the case because this issue is so important to all Californians. All briefs were submitted on January 21. Oral argument is scheduled for March 5.

The petition argues that Proposition 8 is invalid because the California Constitution does not permit the fundamental constitutional rights of a minority to be stripped away by a simple majority vote.
